These Terms of Service govern your use of punartha.com and purchases from Punartha, operated by Punartha Clothing. By accessing the website or placing an order, you agree to these terms, our Privacy Policy, Shipping Policy and Return and Refund Policy.
1. Eligibility and use of the website
You must be legally capable of entering into a binding contract under applicable law. You agree to provide current, complete and accurate information when ordering and not to use the website for any unlawful, fraudulent or unauthorised purpose.
2. Products and availability
We aim to describe and photograph products accurately. Handcrafted and handloom products may have natural variations in weave, texture, colour, pattern and finish; these characteristics are not defects. Colours may also vary between screens. Product availability is subject to change, and we may limit quantities or discontinue products.
3. Prices, taxes and payment
Prices are displayed in Indian Rupees unless another currency is clearly shown. Applicable taxes, shipping charges and the final payable amount are shown before payment. Payment is processed through the payment methods made available at checkout. We do not store complete payment-card credentials.
4. Orders
Submitting an order is an offer to purchase. An order is accepted when we confirm it and begin processing it. We may refuse or cancel an order for reasons including incorrect pricing or product information, unavailable stock, suspected fraud, payment failure or delivery restrictions. If we cancel a paid order, the amount will be returned to the original payment method.
5. Cancellations
Cancellation requests must be sent to punarthaclothing@gmail.com before dispatch. Ready-made, made-to-order, stitched or altered items cannot be cancelled after production or alteration has begun. Once an order has been dispatched, the Return and Refund Policy applies. Approved cancellation refunds are issued to the original payment method within 7 business days.
6. Shipping and delivery
Dispatch and estimated delivery timelines are set out in our Shipping Policy. Sarees and fabrics are normally dispatched on the same business day, while ready-made items are normally dispatched within 3–5 business days. Delivery estimates are not guarantees when delays arise outside our reasonable control.
7. Returns and refunds
Eligibility, exclusions, return shipping and refund timelines are governed by our Return and Refund Policy. Approved refunds are issued to the original payment method within 7 business days after approval, although the payment provider may require additional time to reflect the amount.
8. Intellectual property
The website and its content, including text, photographs, graphics, logos, designs and arrangement, are owned by or licensed to Punartha and are protected by applicable intellectual-property laws. You may use the website only for personal, non-commercial shopping purposes. You may not reproduce, distribute, modify or commercially exploit content without written permission.
9. Third-party services and links
The website may rely on Shopify and third parties for hosting, payment processing, analytics, communication and delivery. Third-party services may be governed by their own terms and privacy policies. Links to third-party websites are provided for convenience and do not make Punartha responsible for their content or practices.
10. Reviews and feedback
If you submit a review, comment or other content, you confirm that it is accurate, lawful and does not violate another person's rights. You permit us to use and display that content for operating and promoting the store, subject to applicable law and our Privacy Policy.
11. Prohibited conduct
You must not interfere with the website's security or operation; introduce malicious code; attempt unauthorised access; scrape or copy the website at scale; impersonate another person; submit false information; infringe intellectual-property or privacy rights; or use the website in violation of law.
12. Disclaimer and limitation of liability
To the maximum extent permitted by law, the website and services are provided on an “as available” basis. Punartha is not liable for indirect, incidental, special or consequential loss arising from use of the website or products. Our aggregate liability for a claim relating to an order will not exceed the amount paid for that order. Nothing in these terms excludes liability or customer rights that cannot lawfully be excluded.
13. Indemnity
You agree to indemnify Punartha against reasonable losses and claims arising from your unlawful use of the website, your breach of these terms or your infringement of another person's rights.
14. Privacy
Our collection and use of personal information are described in the Privacy Policy. By using the website, you acknowledge that information may be processed by Shopify, payment providers, couriers and other service providers as necessary to operate the store and fulfil orders.
15. Governing law and disputes
These terms are governed by the laws of India. Subject to any mandatory consumer forum or other rights available under applicable law, courts in Thrissur, Kerala will have jurisdiction over disputes. We encourage you to contact us first so we can try to resolve any concern promptly.
16. Changes to these terms
We may update these terms to reflect operational, legal or regulatory changes. The revised version will be posted on this page with an updated date and will apply from publication, except where applicable law requires additional notice.
